The case involved a shooting incident which occurred on January 10, 2005. John Steward and Gerald Martin had accidently driven onto property owned by Paul Martin. Mr. Martin decided that he was going to take the law into his own hands and brought two guns with him to confront Mr. Steward and Mr. Martin. As he approached guns in hand, he ordered Mr. Martin to hand over his billfold and lay face down on the street. Mr. Martin, in fear for his life, tossed his billfold to the side and ran to his vehicle. Mr. Green approached the vehicle from the side and attempted to fire through the passenger window. When the gun jammed, Mr. Green ran to the front of the vehicle, switched guns and fired a shot which was deflected by the windshield. Mr. Green then fired four more bullets into the driver side door of Mr. Martin's vehicle. Mr. Martin drove away from the scene and called the police.

Having heard the gunshots, Mr. Steward jumped into his vehicle and attempted to leave the area. He was confronted by Mr. Green who fired two shots into the passenger side door of his truck. Mr. Steward accidently drove down a dead end street and had to return the way he came. As Mr. Steward again passed by Mr. Green, he was confronted by a hail of bullets, one of which went through the driver's door and hit him in the left leg. Mr. Steward escaped the area and drove himself to Marshall Hospital where he also called the police.

Mr. Green was arrested and ultimately convicted by a criminal jury of six felony counts. This case was for the civil damages arising from Mr. Green criminal conduct.

The jury found in favor of Mr. Martin in the sum of $450,000 and in favor of Mr. Steward in the sum of $700,925.23. The jury further found that the plaintiff's are entitled to an award of punitive damages. This portion of the trial is scheduled to be heard by the court on February 14, 2011.
